Terms and Conditions

Please read these terms and conditions of use carefully before using this site.


1. Your Relationship with Ticket Hound

1.1 Your use of Ticket Hound' products, software, services and web sites (referred to collectively as the "Services" in this document) is subject to the terms of a legal agreement between you and Ticket Hound. "Ticket Hound" means K.B. Group Ltd, registered in New Zealand No. 586752, whose Registered Office is at Level 12, 17 Albert St, Auckland 1010, New Zealand. This document explains how the agreement is made up, and sets out some of the terms of that agreement.

1.2 Unless otherwise agreed in writing with Ticket Hound, your agreement with Ticket Hound will always include, at a minimum, the terms and conditions set out in this document. These are referred to below as the "Terms". The Terms, form a legally binding agreement between you and Ticket Hound in relation to your use of the Services. It is important that you take the time to read them carefully.

1.3 By using this site, you signify your assent to these Terms. If you do not agree to these Terms of use, please do not use the site. We reserve the right, at our discretion, to change, modify, add, or remove portions of these Terms at any time. Please check these Terms periodically for changes. Your continued use of the Services following the posting of changes to these Terms will mean you accept those changes.


2. Accepting the Terms

2.1 In order to use the Services, you must firstly agree to the Terms. You may not use the Services if you do not accept the Terms.

2.2 You can accept the Terms by actually using the Services. In this case, you understand and agree that Ticket Hound will treat your use of the Services as acceptance of the Terms from that point onwards.

2.3 You may not use the Services and may not accept the Terms if

(a) you are not of legal age to form a binding contract with Ticket Hound, or

(b) you are a person barred from receiving the Services under the laws of the New Zealand or other countries including the country in which you are resident or from which you use the Services.

2.4 Before you continue, you should print off or save a local copy of the Terms for your records.


3. Provision of the Services by Ticket Hound

3.1 Ticket Hound is constantly innovating in order to provide the best possible experience for its users. You acknowledge and agree that the form and nature of the Services which Ticket Hound provides may change from time to time without prior notice to you.

3.2 As part of this continuing innovation, you acknowledge and agree that Ticket Hound may stop (permanently or temporarily) providing the Services (or any features within the Services) to you or to users generally at Ticket Hound's sole discretion, without prior notice to you. You may stop using the Services at any time. You do not need to specifically inform Ticket Hound when you stop using the Services.

3.3 You acknowledge and agree that if Ticket Hound disables access to your account, you may be prevented from accessing the Services, your account details or any files or other content which is contained in your account.

3.4 You acknowledge and agree that while Ticket Hound may not currently have set a fixed upper limit on the number of transmissions you may send or receive through the Services or on the amount of storage space used for the provision of any Service, such fixed upper limits may be set by Ticket Hound at any time, at Ticket Hound's discretion.


4. Use of the Services by you

4.1 In order to access certain Services, you may be required to provide information about yourself (such as identification or contact details) as part of the registration process for the Service, or as part of your continued use of the Services. You agree that any registration information you give to Ticket Hound will always be accurate, correct and up to date.

4.2 You agree to use the Services only for purposes that are permitted by (a) the Terms and (b) any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions (including any laws regarding the export of data or software to and from the New Zealand or other relevant countries).

4.3 You agree not to access (or attempt to access) any of the Services by any means other than through the interface that is provided by Ticket Hound, unless you have been specifically allowed to do so in a separate agreement with Ticket Hound.

4.4 You agree that you will not engage in any activity that interferes with or disrupts the Services (or the servers and networks which are connected to the Services).

4.5 Unless you have been specifically permitted to do so in a separate, written agreement with Ticket Hound, you agree that you will not reproduce, duplicate, copy, sell, trade or resell the Services for any purpose. No material from this website may be copied, reproduced, republished, amended, modified, revised, edited, changed, added to, deleted, uploaded, posted, transmitted, or distributed in any way, without our express written permission.

4.6 You agree that you are solely responsible for (and that Ticket Hound has no responsibility to you or to any third party for) any breach of your obligations under the Terms and for the consequences (including any loss or damage which Ticket Hound may suffer) of any such breach.

4.7 You agree not to advertise or promote third party or your own products or services, without express written authorisation from Ticket Hound.

4.8 You agree not to access or attempt to access the accounts of other users or to penetrate or attempt to penetrate the Website's security measures.

4.9 You agree not to share any content which is threatening, defamatory, indecent, seditious, offensive, abusive or obscene, or may have the effect of being harassing, threatening or abusive to an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age or disability or otherwise

4.10 You agree to compensate Ticket Hound fully if:

(a) a claim or legal proceeding is brought against Ticket Hound by any other person as a result of your breach of these Terms; and/or

(b) You have acted negligently, recklessly or in a deliberately harmful way and Ticket Hound have suffered losses as a result of your use of the website or any content you have submitted to us.


5. Your Passwords and Account Security

5.1 You agree and understand that you are responsible for maintaining the confidentiality of passwords associated with any account you use to access the Services.

5.2 Accordingly, you agree that you will be solely responsible to Ticket Hound for all activities that occur under your account.

5.3 If you become aware of any unauthorised use of your password or of your account, you agree to notify Ticket Hound immediately.


6. Privacy and your Personal Information

6.1 In order to provide our full range of services, we may collect different types of information from you. We offer a service that provides a facility for you to provide personal information to us. When you sign up for a Ticket Hound account that requires registration, we ask you for personal information (such as your name, email address and an account password). If we use this information in a manner different from the purpose for which it was collected, then we will ask for your consent prior to such use.

6.2 When you access Ticket Hound services, our servers automatically record information that your browser sends whenever you visit a website. These server logs may include information such as your web request, Internet Protocol address, browser type, browser language, the date and time of your request and one or more cookies that may uniquely identify your browser.

6.3 When you send emails or other communications to Ticket Hound, we may retain those communications in order to process your enquiries, respond to your requests and improve our services.

6.4 Ticket Hound does not share your personal information with other companies or individuals outside Ticket Hound unless you have specifically agreed to allow the same either when you created your account or any subsequent time.

6.5 If Ticket Hound becomes involved in a merger, acquisition or any form of sale of some or all of its assets, we will ensure the confidentiality of any personal information involved in such transactions and provide notice before personal information is transferred and becomes subject to a different privacy policy.

6.6 You agree to the use of your data in accordance with these Terms.


7. Information Security and Data Integrity

7.1 We take appropriate security measures to protect against unauthorised access to or unauthorised alteration, disclosure or destruction of data. These include internal reviews of our data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorised access to systems where we store personal data.

7.2 We restrict access to personal information to Ticket Hound employees, contractors and agents who need to know that information in order to operate, develop or improve our Services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.

7.3 Ticket Hound processes personal information only for the purposes for which it was collected and in accordance with these Terms. We review our data collection, storage and processing practices to ensure that we only collect, store and process the personal information needed to provide or improve our services or as otherwise permitted under these Terms. We take reasonable steps to ensure that the personal information that we process is accurate, complete and current, but we depend on our users to update or correct their personal information whenever necessary.


8. Accessing and Updating Personal Information

8.1 When you use Ticket Hound services, we make good-faith efforts to provide you with access to your personal information and either to correct this data if it is inaccurate, or to delete such data at your request if it is not otherwise required to be retained by law or for legitimate business purposes. We ask individual users to identify themselves and the information that they request be accessed, corrected or removed before processing such requests and we may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardise the privacy of others or would be extremely impractical (for instance, requests concerning information residing on backup tapes) or for which access is not otherwise required. In any case where we provide information access and correction, we perform this service free of charge, except if doing so requires a disproportionate effort.


9. Content in the Services

9.1 You understand that all information (such as data files, written text, computer software, music, audio files or other sounds, photographs, videos or other images) which you may have access to as part of, or through your use of, the Services are the sole responsibility of the person from which such content originated. All such information is referred to below as the "Content".

9.2 You should be aware that Content presented to you as part of the Services, including but not limited to advertisements in the Services and sponsored Content within the Services may be protected by intellectual property rights which are owned by the sponsors or advertisers who provide that Content to Ticket Hound (or by other persons or companies on their behalf). You may not modify, rent, lease, loan, sell, distribute or create derivative works based on this Content (either in whole or in part) unless you have been specifically told that you may do so by Ticket Hound or by the owners of that Content, in a separate agreement.

9.3 Ticket Hound reserves the right (but shall have no obligation) to pre-screen, review, flag, filter, modify, refuse or remove any or all Content from any Service.

9.4 You understand that by using the Services you may be exposed to Content that you may find offensive, indecent or objectionable and that, in this respect, you use the Services at your own risk.

9.5 You agree that you are solely responsible for (and that Ticket Hound has no responsibility to you or to any third party for) any Content that you create, transmit or display while using the Services and for the consequences of your actions (including any loss or damage which Ticket Hound may suffer) by doing so.

9.6. You warrant that all Content is your original work and is not owned by any other person or entity; do not violate any law or regulation; and do not infringe the rights of any person or entity, including, but not limited to, any copyright or trademark rights and/or rights of privacy or publicity. Neither Ticket Hound nor its officers, partners, directors, employees, agents, successors, or assigns shall be liable for any costs, damage, injury, or any other claims incurred as a result of you uploading Content that violates these Terms.

9.7. You may not contribute Content that is obscene or pornographic or any material that could give rise to any civil or criminal liability under applicable law or regulations.

9.8. You may not upload Content that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of the Services.


10. Proprietary Rights and Licences

10.1 You acknowledge and agree that Ticket Hound own all legal right, title and interest in and to the Services, including any intellectual property rights which subsist in the Services (whether those rights happen to be registered or not, and wherever in the world those rights may exist). You further acknowledge that the Services may contain information which is designated confidential by Ticket Hound and that you shall not disclose such information without Ticket Hound' prior written consent.

10.2 Unless you have agreed otherwise in writing with Ticket Hound, nothing in the Terms gives you a right to use any of Ticket Hound trade names, trade marks, service marks, logos, domain names, and other distinctive brand features.

10.3 By submitting, posting, displaying or uploading any Content to Ticket Hound, you grant to Ticket Hound, a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive licence and right to copy, adapt, modify, translate, publish, display, distribute, sublicense or otherwise use any Content which you submit, post or display on or through, the Services, in all languages and all media, whether now known or hereinafter devised, including without limitation on the Internet, on mobile platforms and/or devices, in printed materials, and in the advertising, publicity and promotion thereof.

10.4 You agree that you shall not remove, obscure, or alter any proprietary rights notices (including copyright and trade mark notices) which may be affixed to or contained within the Services.

10.5 Unless you have been expressly authorised to do so in writing by Ticket Hound, you agree that in using the Services, you will not use any trade mark, service mark, trade name, logo of any company or organisation in a way that is likely or intended to cause confusion about the owner or authorised user of such marks, names or logos.

10.6 Ticket Hound gives you a personal, worldwide, royalty-free, non-assignable and non-exclusive licence to use the software provided to you by Ticket Hound as part of the Services as provided to you by Ticket Hound (referred to as the "Software" below). This licence is for the sole purpose of enabling you to use and enjoy the benefit of the Services as provided by Ticket Hound, in the manner permitted by the Terms.

10.7 You may not (and you may not permit anyone else to) copy, modify, create a derivative work of, reverse engineer, decompile or otherwise attempt to extract the source code of the Software or any part thereof, unless this is required by law, or unless you have been specifically told that you may do so by Ticket Hound, in writing.

10.8 Unless Ticket Hound has given you specific written permission to do so, you may not assign (or grant a sub-licence of) your rights to use the Software, grant a security interest in or over your rights to use the Software, or otherwise transfer any part of your rights to use the Software.

10.9 You understand that Ticket Hound, in performing the required technical steps to provide the Services to our users, may

(a) transmit or distribute your Content over various public networks and in various media; and

(b) make such changes to your Content as are necessary to conform and adapt that Content to the technical requirements of connecting networks, devices, services or media. You agree that this licence shall permit Ticket Hound to take these actions.

10.10 You confirm and warrant to Ticket Hound that you have all the rights, power and authority necessary to grant the above licence.

10.11 Ticket Hound reserves the right to suspend, restrict or terminate access to the Services or any part of it at any time without notice. We endeavour to ensure that the Services are always available but do not guarantee that it will be available uninterrupted or error free.


11. Software Updates

11.1 The Software which you use may automatically download and install updates from time to time from Ticket Hound. These updates are designed to improve, enhance and further develop the Services and may take the form of bug fixes, enhanced functions, new software modules and completely new versions. You agree to receive such updates (and permit Ticket Hound to deliver these to you) as part of your use of the Services.


12. Ending your Relationship with Ticket Hound

12.1 The Terms will continue to apply until terminated by either you or Ticket Hound as set out below.

12.2 If you want to terminate your legal agreement with Ticket Hound, you may do so by

(a) notifying Ticket Hound at any time and

(b) closing your accounts for all of the Services which you use, where Ticket Hound has made this option available to you. Your notice should be sent, in writing, to Ticket Hound' address which is set out at the beginning of these Terms.

12.3 Ticket Hound may at any time, terminate its legal agreement with you if:

(a) you have breached any provision of the Terms (or have acted in manner which clearly shows that you do not intend to, or are unable to comply with the provisions of the Terms); or

(b) Ticket Hound is required to do so by law (eg, where the provision of the Services to you is, or becomes, unlawful); or

(c) the partner with whom Ticket Hound offered the Services to you has terminated its relationship with Ticket Hound or ceased to offer the Services to you; or

(d) Ticket Hound is transitioning to no longer providing the Services to users in the country in which you are resident or from which you use the service; or

(e) the provision of the Services to you by Ticket Hound is, in Ticket Hound' opinion, no longer commercially viable.

12.4 Nothing in this Section shall affect Ticket Hound' rights regarding provision of Services under Section 3 of the Terms.

12.5 When these Terms come to an end, all of the legal rights, obligations and liabilities that you and Ticket Hound have benefited from, been subject to (or which have accrued over time whilst the Terms have been in force) or which are expressed to continue indefinitely, shall be unaffected by this cessation, and the provisions of paragraph 20.7 shall continue to apply to such rights, obligations and liabilities indefinitely.


13. Exclusion of Warranties

13.1 The Services are provided "as is" and Ticket Hound, its Subsidiaries and Affiliates, and its licensors give you no warranty with respect to them.

13.2 In particular, Ticket Hound, its Subsidiaries and Affiliates, and licensors do not represent or warrant to you that:

(a) your use of the Services will meet your requirements,

(b) your use of the Services will be uninterrupted, timely, secure or free from error,

(c) any information obtained by you as a result of your use of the Services will be accurate or reliable, and

(d) that defects in the operation or functionality of any Software provided to you as part of the Services will be corrected.

13.3 No conditions, warranties or other terms (including any implied terms as to satisfactory quality, fitness for purpose or conformance with description) apply to the Services except to the extent that they are expressly set out in the Terms.

13.4 Nothing in the Terms shall affect those statutory rights which you are always entitled to as a consumer and that you cannot contractually agree to alter or waive.


14. Links to and from other Services

14.1 You may link to the Services provided that you do so in a fair and legal way and not in a way that may damage or takes advantage of our reputation or that suggests any form of association, approval or endorsement on our part.

14.2 You may not frame the Services for any reason unless Ticket Hound give you express, written permission (which Ticket Hound may withdraw at any time).

14.3 Where the Services contain links to other websites provided by third parties, these links are provided for your information only and do not constitute an endorsement by Ticket Hound of these sites. Ticket Hound have no control over the contents of those sites, and accept no responsibility for them or any loss or damage that may arise from your use of them.

14.4 Where the Services contain links to other websites provided by third parties, these sites are not in any way approved, checked, edited, vetted or endorsed by us and you agree that we shall not be responsible or liable in any way for the content, advertising or products available from such sites, the quality, functionality, suitability or legality of such sites or for any dealings that you may have, or the consequences of such dealings, with such third party site operators. You also agree that any dealings you have with such third party site operators shall be on the terms and conditions (if any) of the third party operator and you hereby waive any claim you might have against us with respect to such sites. You agree that we are not liable in any way for and you agree to indemnify us in the manner referred to below in these Terms in relation to such dealings. Any arrangements made between you and any third party named on the site are at your sole risk and responsibility.


15. About the information on the Services

15.1 We aim to update the Services regularly, and may change the content at any time. Any of the material on the Services may be out of date at any given time and we are under no obligation to update this material, nor inform you regarding any changes.


16. The ordering process and order confirmations

16.1 Your order constitutes an offer to Ticket Hound to buy the relevant product(s). All orders are subject to availability and to acceptance by Ticket Hound. The contract for purchase of the product is only entered into when Ticket Hound send you an email confirming acceptance of your offer or display to you a confirmation screen confirming acceptance of your offer.

16.2 Ticket Hound reserve the right to cancel or not accept an order for any reasonable reason (including, but not limited to where we have not been able to obtain authorisation for payment, you have attempted to purchase more than 50 items without our prior agreement, a product is out of stock. If Ticket Hound cancel Your purchase, you will be refunded in accordance with these Terms.


17. Limitation of Liability

17.1 Nothing in these Terms shall exclude or limit Ticket Hound' liability for losses which may not be lawfully excluded or limited by applicable law.

17.2 You expressly agree that your use of and browsing of the Services are at your own risk. Neither Ticket Hound Ltd nor any other party involved in creating, producing or delivering the Services is liable for any direct, incidental, special, consequential, indirect or punitive damages arising out of your access to, or use of, or inability to use the Services or for the cost of procurement of substitute goods or services or resulting from any goods or services purchased or obtained or messages received or transactions entered into through the site or resulting from any unauthorized access to or alteration of your transmissions or data, including but not limited to, damages for loss of profits, use, data or other intangible property

17.3 Subject to overall provision in paragraph 14.1 above, Ticket Hound, its Subsidiaries and Affiliates, and its licensors shall not be liable to you for:

(a) any direct, indirect or consequential losses which may be incurred by you. This shall include any loss of profit (whether incurred directly or indirectly), any loss of goodwill or business reputation, or any loss of data suffered by you;

(b) any loss or damage which may be incurred by you as a result of: (i) any reliance placed by you on the completeness, accuracy or existence of any advertising, or as a result of any relationship or transaction between you and any advertiser or sponsor whose advertising appears on the Services; (ii) any changes which Ticket Hound may make to the Services, or for any permanent or temporary cessation in the provision of the Services (or any features within the Services); (iii) the deletion of, corruption of, or failure to store, any Content and other communications data maintained or transmitted by or through your use of the Services; (iii) your failure to provide Ticket Hound with accurate account information; (iv) your failure to keep your password or account details secure and confidential; (v) failure of goods or services or tickets ordered by you to be delivered on time or to the agreed destination;

17.4 You acknowledge and agree that Ticket Hound is acting solely as an agent for the distribution of the goods and services being requested or purchased.

17.5 The limitations on Ticket Hound's liability to you in paragraph 17.3 above shall apply whether or not Ticket Hound has been advised of or should have been aware of the possibility of any such losses arising.

17.6 You agree to indemnify, keep indemnified, defend and hold Ticket Hound Ltd and its parent companies, subsidiaries, affiliates and their respective officers, directors, employees, owners, agents, information providers and licensors harmless from and against any and all claims, damages, liability, losses, costs and expenses (including legal fees) (whether or not foreseeable or avoidable) incurred or suffered by any of these parties and any claims or legal proceedings which are brought or threatened arising from your use of, connection with or conduct on the Services or any breach by you of these Terms. Ticket Hound Ltd reserves the right, at its own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, and in such case, you agree to co-operate with our defence of such claim.


18. Copyright and Trade Mark policies

18.1 It is Ticket Hound's policy to respond to notices of alleged copyright infringement that comply with applicable international intellectual property law and to terminating the accounts of repeat infringers.


19. Advertisements

19.1 Some of the Services may be supported by advertising revenue and may display advertisements and promotions. These advertisements may be targeted to the content of information stored on the Services, queries made through the Services or other information.

19.2 The manner, mode and extent of advertising by Ticket Hound on the Services are subject to change without specific notice to you.

19.3 In consideration for Ticket Hound granting you access to and use of the Services, you agree that Ticket Hound may place such advertising on the Services.


20. Prices and Payment

20.1 All prices on the Ticket Hound website are in New Zealand Dollars (NZD). The price of a product shall be as stated on the Services at the time you place your order except in the case of obvious error. Our prices may change at any time, but price changes will not affect orders we have already confirmed with you. If the price of a product is obviously wrong, we will not be obliged to provide the product to you at that price and will give you the option of confirming your order at the correct price or cancelling your order, in which case you will be refunded the price of the order and any fees.

20.2 Prices shown are inclusive of New Zealand GST at the prevailing rate. However, if the rate of GST changes between the date of your order and the date we take payment, we will adjust the rate of GST that you pay. You may be charged fees which shall be as stated on the Services at the time you place Your order.

20.3 It is always possible that, despite Our best efforts, some of the products Ticket Hound sell may be incorrectly priced. We will normally check prices before accepting your order so that, where the product's correct price at your order date is less than our stated price at your order date, we will charge the lower amount. If the product's correct price at your order date is higher than the price stated to you, We will contact you for your instructions before we accept your order. If we accept and process your order where a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, we may end the contract, refund you any sums you have paid and cancel any items provided to you.

20.4 We accept payment by credit card and debit card, direct bank transfer, Apple Pay and Google Wallet. Payment will be debited from your account at the time of or shortly before confirmation of your purchase. You confirm that the credit/debit card or other payment device that is being used is yours. All payment systems are subject to validation checks and authorisation by the card issuer or payment solution provider. If the issuer of your card or other payment solution refuses to authorise payment, we will not accept your order and we will not be responsible for any delay or non-delivery and we are not obliged to inform you of the reason for the refusal.

20.5 We are not responsible for your card issuer or bank charging you as a result of our processing of your credit/debit card payment in accordance with your order.

20.6 We reserve the right to provide you with alternative items to those stated on any orders you create, provided that the replacement item(s) are of equivalent or greater quality.


21. Delivery of Products

21.1 We shall deliver your ordered items to you via the chosen despatch method you selected at the time of creating your order. Prices shown on the Services do not include any despatch costs (if these are applicable) and are itemised at the checkout, based on your chosen delivery address.

21.2 If you select standard mail, registered post or courier as your delivery method, you shall be charged an additional amount when placing your order as stated on the Services, during your order process as applicable to the selected delivery method. We currently only accept orders for etickets, standard mail, registered delivery or courier to New Zealand only.

21.3 Not all despatch methods are available for all products. Available despatch methods pertinent to each product sold will be presented on the Services at the checkout.

21.4 If you select courier as your delivery method, we will include the courier tracking reference in the order confirmation. You can use this to track the delivery of your items..

21.5 We shall endeavour to send any ordered products as soon as practically possible, however deliveries may be subject to delays from the delivery service provider. Ticket Hound accepts no liability for delays in the delivery of any products that are caused by 3rd party service delivery providers that are outside our jurisdiction.

21.6 We shall endeavour to deliver your voucher to you as soon as possible after you place your order and in any event within 7 days (beginning on the day after the day you place your order) unless you have agreed a later delivery date. If we consider that We are unable to deliver the product within the timescales set out in this paragraph, we will email to let you know.

21.7 As soon as the product is delivered to you, or to the person nominated by you to take delivery on your behalf, you are responsible for it.

21.8 If you are unhappy with your purchase in any way please contact our customer service team on help@tickethound.co.nz as soon as possible.


22. Ticket Hound Gift Vouchers

22.1 Gift vouchers can only be redeemed in accordance with these Terms and by ordering online via the Services.

22.2 Gift vouchers will automatically expire 12 months from and including the date they have been issued. Ticket Hound may consider, at its absolute discretion, an extension to the expiry date of a gift voucher on a case-by-case basis where there are extenuating circumstances to justify such extension being appropriate and fair (such as a global pandemic rendering a gift voucher non-redeemable). Products against which a gift voucher may be redeemed will only be issued subject to availability. Gift vouchers may only be redeemed against products purchased directly from Ticket Hound. Gift vouchers do not apply to and cannot be redeemed against any other purchases of items other than Ticket Hound.

22.3 Gift vouchers can be used as full or part payment for applicable items. The cost of any item(s) exceeding the value of a gift voucher must be paid with other valid Ticket Hound gift vouchers, debit or credit card paments or any other valid means of payment that may be accepted by Ticket Hound. If the value of a gift voucher is higher than the value of the ticket(s) then you will be given a further gift voucher for a value equivalent to the remaining balance.

22.4 Gift vouchers have a cash value of $0.001c. Gift vouchers are non-refundable.

22.5 Gift vouchers cannot be redeemed against orders that are already placed or booked.

22.6 Copyright and all intellectual property rights on gift vouchers belong to Ticket Hound and all such rights are reserved. Gift vouchers must not be copied or duplicated in any way (in whole or in part).

22.7 Gift vouchers must not be defaced, amended, modified or tampered with in any way otherwise they will become null and void. Only original gift vouchers (and not copies) can be redeemed against tickets for items.

22.8 Gift vouchers will be redeemed subject to items being issued under the standard terms and conditions which apply to such items.

22.9 Gift vouchers are issued subject to these terms and conditions which apply to gift vouchers and any decision made by Ticket Hound in relation to or in connection with these terms and conditions and/or gift vouchers shall (save for manifest and obvious error or fraud) be conclusive, final and binding upon the holder of the gift voucher and/or any other relevant third parties in relation to the gift voucher.

22.10 Gift vouchers cannot be replaced or redeemed against items if the gift voucher is lost, stolen, damaged or otherwise unavailable at the time of purchase of items from Ticket Hound.


23. Cancellations, Rescheduling and Exchanges

23.1 Order items may not be exchanged other than Ticket Hound may consider such a request on a case-by-case basis (taking into account the specific factors of the exchange request). Ticket Hound reserve the right to accept or reject such requests at our absolute discretion without any explanation.

23.2 We reserve the right to make alterations to the advertised products as a result of circumstances beyond our control, such as, but not limited to, artist cancellation, product availability, the weather, seasonal variations, delivery constraints and restrictions, etc.

23.3 When an event is rescheduled, if Ticket Hound is the event promoter, Ticket Hound will offer tickets for the new event date or the choice of a refund.

23.4 When an event is rescheduled, if Ticket Hound is not the event promoter, exchanges will be subject to the terms of teh event promoter.


24. Refunds

24.1 No tickets, products or goods may be returned to Ticket Hound without a Return Authorisation from Ticket Hound.

24.2 All refunds remain the absolute discretion of the event promoter. This may be a third party that has engaged Ticket Hound to provide the Services.

24.3 Where Ticket Hound is the event promoter, Ticket Hound will refund customers tickets and any associated fees, when events are cancelled. All other circumstances are at the absolute discretion of Ticket Hound.

24.4 If you are permitted to refund a product under these Terms, we will send you a Return Authorisation with detailed instructions on where to send the products being returned. If Ticket Hound have agreed to a refund, we will refund the agreed amount of products returned within 14 days (beginning on the day after the day we receive the products back from you or, if earlier, the day on which you provide evidence that you have sent back the products) using the same means of payment used for your initial purchase (unless you agree otherwise). We will not refund the cost of returning products to us or the cost of delivery charges except as expressly set out in these Terms.

24.5 We recommend that whenever you return products to us, you send them via an insured, traceable delivery service. Please return products to us in suitable packaging to ensure they reach us in good condition.


25. Other Content

25.1 The Services may include hyperlinks to other web sites or content or resources. Ticket Hound may have no control over any web sites or resources which are provided by companies or persons other than Ticket Hound.

25.2 You acknowledge and agree that Ticket Hound is not responsible for the availability of any such external sites or resources, and does not endorse any advertising, products or other materials on or available from such web sites or resources.

25.3 You acknowledge and agree that Ticket Hound is not liable for any loss or damage which may be incurred by you as a result of the availability of those external sites or resources, or as a result of any reliance placed by you on the completeness, accuracy or existence of any advertising, products or other materials on, or available from, such web sites or resources.


26. Changes to the Terms

26.1 Ticket Hound may make changes to the Terms from time to time. When these changes are made, Ticket Hound will make a new copy of the Terms available at https://www.tickethound.co.nz/terms.asp.

26.2 You understand and agree that if you use the Services after the date on which the Terms have changed, Ticket Hound will treat your use as acceptance of the updated Terms.


27. General Legal Terms

27.1 Sometimes when you use the Services, you may (as a result of, or through your use of the Services) use a service or download a piece of software, or purchase goods, which are provided by another person or company. Your use of these other services, software or goods may be subject to separate terms between you and the company or person concerned. If so, the Terms do not affect your legal relationship with these other companies or individuals.

27.2 The Terms constitute the whole legal agreement between you and Ticket Hound and govern your use of the Services (but excluding any services which Ticket Hound may provide to you under a separate written agreement), and completely replace any prior agreements between you and Ticket Hound in relation to the Services.

27.3 You agree that Ticket Hound may provide you with notices, including those regarding changes to the Terms, by email, regular mail, or postings on the Services.

27.4 You agree that if Ticket Hound does not exercise or enforce any legal right or remedy which is contained in the Terms (or which Ticket Hound has the benefit of under any applicable law), this will not be taken to be a formal waiver of Ticket Hound' rights and that those rights or remedies will still be available to Ticket Hound.

27.5 If any court of law, having the jurisdiction to decide on this matter, rules that any provision of these Terms is invalid, disallowed or ineffective, including, but not limited to the Fair Trading Act or the Consumer Guarantees Act, then that provision will be removed from the Terms without affecting the rest of the Terms. The remaining provisions of the Terms will continue to be valid and enforceable.

27.6 You acknowledge and agree that each member of the group of companies of which Ticket Hound is the parent shall be third party beneficiaries to the Terms and that such other companies shall be entitled to directly enforce, and rely upon, any provision of the Terms which confers a benefit on (or rights in favour of) them. Other than this, no other person or company shall be third party beneficiaries to the Terms.

27.7 The Terms, and your relationship with Ticket Hound under the Terms, shall be governed by New Zealand law. You and Ticket Hound agree to submit to the exclusive jurisdiction of the courts of New Zealand to resolve any legal matter arising from the Terms. Notwithstanding this, you agree that Ticket Hound shall still be allowed to apply for injunctive remedies (or an equivalent type of urgent legal relief) in any jurisdiction.

27.8 We may wish to transfer our rights or obligations or sub-contract our obligations under these Terms to another other legal entity. You agree that we may do so provided that:

(a) this will not adversely affect the standard of the products or the service you receive under these Terms; and

(b) in the case of transfer only, after we notify you of the date on which we will transfer our rights and obligations under these Terms to another legal entity, Your only rights under or in connection with these Terms will be against the new legal entity and not against us.

27.9 These Terms are personal to you. You may not transfer your rights or obligations under these Terms to anyone else without our written consent.

27.10 These Terms are not intended to give rights to anyone except you and us.

27.11 We will only use your personal information as set out in our Privacy Policy.


28. Jurisdiction

28.1 Unless otherwise specified, the materials in the site are presented solely for the purpose of promoting the products and services of Ticket Hound Ltd. This site is controlled and operated by Ticket Hound Ltd from its offices within New Zealand. Ticket Hound Ltd makes no representation that materials in the site are appropriate or available for use in other locations. Those who choose to access this site from other locations do so at their own risk and are responsible for compliance with local laws, if and to the extent local laws are applicable.

28.2 In the event that any provision of these Terms conflicts with the law under which the Terms are to be construed or if any such provisions are held invalid by a court with jurisdiction over the parties to the Terms, such provision will be deemed to be restated to reflect as nearly as possible the original intentions of the parties in accordance with applicable law, and the remainder of these Terms will remain in full force and effect.

28.3 These Terms shall be governed by and construed in accordance with the laws of New Zealand. If any provision of these Terms shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions. These Terms and any Additional Terms constitute the entire agreement between us relating to the subject matter herein and shall not be modified except in writing, signed by both parties.


29. What to do if you are unhappy

29.1 If you are unhappy, in the first instance please contact us on help@tickethound.co.nz. We will do our best to resolve any disputes over these Terms.

29.2 If we are unable to resolve any disputes between you and us, you have the right to refer the dispute to the New Zealand Dispute Resolution Centre service.

29.3 These Terms are only available in the English language.



30. Use By Event Organisers

30.1 If you have booked or registered for events that are listed by an Event Organiser using Ticket Hound and the Ticket Hound platform, a record of your booking data is made available to the Event Organiser. Your booking data is provided to the Event Organiser for their records, analysis and to allow them to operate their event effectively.

30.2 Event Organisers shall only be entitled to contact you directly in respect of future events or offers if, at the time of purchase, you agree to receiving such information. The applicable venue, promoter and/or artist may then use these details to contact you with information and offers regarding future events and promotions. Whenever your data is provided to Event Organisers, it is clearly marked with your relevant marketing opt-in selection.

30.3 If you wish to change this choice you can contact us, but it may be necessary to contact the applicable venue, promoter and/or artist directly if your contact details have already been provided to them. These parties will use your personal information in accordance with their own privacy policies. If the applicable venue, promoter and/or artist contacts you and you wish to unsubscribe from this communication or if you have any questions regarding their privacy policy you should contact them directly.
